The terms and conditions ("Agreement") sets forth the general terms and conditions of your use of the statorium.com website ("Website" or "Service") and any of its related services ("Services"). This Agreement is legally binding between you ("User", "Client") and Statorium.com ("Statorium", "we" ). By accessing and using the Website and Services, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement. If you do not agree with the terms of this Agreement, you must not accept this Agreement and may not access and use the Website and Services.

Subscriptions

The Services offered are paid upfront as a monthly or annual based subscriptions. You can cancel your subscription at any time.

Some selected competitions (e.g. football world cup 2018) data access or news feeds dedicated to such competition may be offered as one-time fee packages. 

Licensed domains/apps

The data or news feed purchased are licensed within one domain / mobile app until the different is agreed between Client and Service. Client shall notify Us about the domain name licensed during the purchase process.

Payment methods, invoices and taxation

All payments are handled by our official payment provider 2Checkout (formerly Avangate B.V.), The Netherlands. Payment gateway provides all the official documents such as invoices, receipts and other. Pricing offered is NET pricing. Local taxes might be applicable for selected countries. 

Price changes

The pricing of our services may change time to time. You will be notified 30 days prior to such changes to take the appropriate decision.

We want you to be fully satisfied with our Statorium.com services. To ensure your satisfaction we offer 30 days money back guarantee for all the new service purchases. If you are not happy about the product for absolutely any reason you can request a full refund within the money back guarantee period.

The refund cannot be applied for renewals. Once renewal is paid you will not be eligible for refund.

The refund period for one-time fee service packages dedicated to selected events are limited to 15 days.

Account

Your account on Statorium.com and API token provided may not be shared with third parties. You are responsible for taking care about your account security. You are responsible for keeping your contact details up to date.

You cannot resell or redistribute Statorium.com data without the appropriate approval.

Service as is

We provide our services as is. We take all possible efforts to collect the correct data however we cannot guarantee 100% accuracy due to many applicable factors.

We do not hold responsibility for any financial or other losses or damages incurred through the use or termination of our services and data, including but not limited to damages caused by a commercial loss, a loss of benefits, a loss on anticipated earnings, winnings or other profit, interruption of business, loss of commercial information, or any other pecuniary and or consecutive loss.

Image / logo copyrights

We follow the fair use law providing the image sources. The images are used solely to identify the public Clubs / Players / Stadiums. All images belongs to their authors, Statorium have no ownership on any image delivered through the API.

Arrange the proof of intellectual property on your own to meet your local copyright law.

Client can be supplied with the appropriately licensed images on request. In such cases We supply with the official images license from our partners, third party Image Stock Company.

Jurisdiction

Statorium services is governed, construed, and enforced according to the Belarusian laws. Any actions you or Statorium bring to enforce these terms of service or any matters related to the website shall be subject to the Belarus courts’ jurisdiction.

The right to refuse

We reserve the right to cancel the service or refuse the purchase at any time.

Force Majeure

The Parties are released from the liability for partial or full non-performance hereunder in the event of Acts of God (force majeure). Force majeure shall mean extraordinary events beyond the affected Party’s control that did not exist at the date of signing of the present Agreement and which the affected Party could not reasonably prevent through the measures and means that could be reasonably demanded and expected from the Party affected by Acts of God. Acts of God shall include (without limitation) war and military action, natural calamities, international embargo, sanctions and other events that impede performance hereunder and meet criteria of Force majeure set forth in this Clause. The Party claiming force majeure shall notify the other Party of the force-majeure occurrence within three days and claim the estimated duration thereof and provide evidence of such force majeure. The term of the obligations performance hereunder shall be extended pro rata to the duration of the force majeure event described in this Article and the period reasonably required to mitigate the implications thereof providing that a notice of such event was duly submitted. Should the duration of the force majeure exceeds 3 (three) months, each of the Parties shall have the right to terminate the Agreement provided that neither of the Parties shall have the right to demand from the other Party compensation of possible damages.
